NON-TRANSFERABLE — Ad space purchased is for contracted advertiser only and is not transferable

RIGHT TO REJECT ADVERTISING – Payment of ad space does not guarantee space in the guide. Go See Us reserves the right to accept or reject any advertising order for any reason at any time without any liability or obligation.

DEADLINE FOR SUBMISSION — The Ad Space Application/Contract submittal deadline is April 20th, 2009, and must be accompanied by full payment (in U.S. funds only). If the required payment and Ad Space Application/Contract are not received by April 20th, 2009, the Advertiser will lose their ad space assignment.

FEE — Fees submitted with this application form are for space assigned in the Go See USTM 2009 Guide only.

REFUND – All payments for Translation and Design services are not refundable. Refunds of 90% of ad space payment will be paid after May 1st, 2009 for requests received by March 1st, 2008. No refund requests will be accepted after March 1st, 2009.

CANCELLATION OF GUIDE — If for any reason the guide is cancelled after contract has been signed, Go See US shall have no liability to any Advertiser except to refund the entire amount of the advertising payment. Graphic Design/Translation payments will only be refunded if the Advertiser agrees not to use the delivered creative/translation elsewhere.

NO WARRANTY; LIMITATION OF LIABILITY — GO SEE US DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. In the event of an error in any advertisement or advertisement placement, the liability of Go See US shall be limited to refund of the full amount of the ad space payment

INTELLECTUAL PROPERTY — Advertiser represents that it has the legal right to use the text, graphics and images in the ad and that nothing in the ad infringes on any copyright, trademark, patent or other intellectual property right or any moral right of any other party.

INDEMNIFICATION — Advertiser assumes full responsibility for the content of ads and agrees to defend, indemnify and hold harmless Go See US and New Circle Consulting, Inc. and their officers, directors, employees, shareholders and agents from and against all claims, demands, actions, damages, liabilities, expenses, and judgments, including reasonable attorneys’ fees and litigation expenses relating to or arising from any advertisement placed by Advertiser including any claim of infringement of any intellectual property rights.
